JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 This is an application for grant of anticipatory bail in connection with Daudnagar Case No.205 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R and the seizure list, there is recovery of 148.140 liters of foreign liquor from the hut situated in the filed of the petitioner.

Submission of the learned counsel for the petitioner is that the hut belongs to the son of the petitioner and both son and petitioner have been made accused in this case. He has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that F.I.R. and seizure list both disclosed the recovery from the land of the petitioner.

No.65744 of 2019(2) dt.21-10-2019 2/2 Having heard both sides, in view of the allegation and the quantity of the liquor recovered from the shop of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he may surrender and pray for regular bail, the learned court below shall consider the above submission made by the learned counsel for the petitioner and considering the same will pass appropriate order, without being prejudiced by order of this Court.
