JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 23-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Patna Airport P.S. Case No. 170 of 2016 registered under Section 364, 120-B of the Indian Penal Code.

Two Delhi based businessmen are said to have been kidnapped by some unknown miscreants from the Jai Prakash Narayan International Airport, Patna and during the course of combing operation one Ranjit Mandal alias Ranjit Don was apprehended who disclosed the name of the petitioner as his accomplice in the occurrence.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent. He has no concern with the

Patna High Court Cr.Misc. No.27113 of 2018 (03) dt.23-05-2018 - 2 - aforesaid occurrence. He is neither named in the F.I.R. nor he was apprehended on the spot. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring the confessional statement of Ranjit Mandal alias Ranjit Don which has no evidentiary value in the eye of law. Though two criminal cases have been lodged against the petitioner but he is on bail in the aforesaid cases. The petitioner has been languishing in custody since 26.10.2016. The aforesaid Ranjit Mandal alias Ranjit Don has been enlarged on bail by a coordinate bench of this court in Cr. Misc. No.29115 of 2017 vide order dated 31.07.2017. On the other hand, learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XV, Patna in connection with Patna Airport P.S. Case No. 170 of 2016.
