The petitioner seeks bail in connection with Excise Case No. 825 of 2019 for the offence under Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner and the petitioner has no concern with the alleged recovery. The petitioner, who is of clean antecedent, is rotting in judicial custody since 04.09.2019.

Considering the facts and circumstances of the

Patna High Court CR. MISC. No.64858 of 2019(2) dt.24-10-2019 2/2 case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise) -cum- Additional District Judge-VII, East Champaran, Motihari in connection with Excise Case No.825 of 2019.
