The petitioner seeks regular bail in connection with Special Case No. 175 of 2017 arising out of Danapur P.S. Case No. 121 of 2017 for the offences punishable under Section(s) 8/20, (b) (ii) (c) of the N.D.P.S. Act.

The allegation is regarding the recovery of 9.5 k.g. ganza kept in air bag carried by the petitioner.

The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the quantity of ganza seized from the petitioner is not a commercial quantity as per the appendix attached to the NDPS Act, hence, the petitioner may be released on bail. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 3rd -cum- Special Judge, C.B.I.-2, Patna in connection with Special Case No. 175 of 2017 arising out of Danapur Rail P.S. Case No. 121 of 2017.
