19-06-2023 Heard learned counsel for the parties.

The petitioner apprehends his arrest in a case registered for the offence under Section 341, 323, 498(A), 376 of the Indian Penal Code.

It is alleged that on the false promise of marriage, this petitioner established physical relation with the informant, as a result of which, she became pregnant and gave birth to a child and thereafter, this petitioner refused to marry her. It is submitted on behalf of petitioner that informant is none else but own Bhabhi (sister-in-law) of the petitioner. The physical relationship between the parties was continued for a long time, but the informant did not lodge any F.I.R. Even in the F.I.R., the informant has not disclosed the date-of-birth of child. As a matter of fact, in order to grab the property, the informant has lodged this false and concocted case against this petitioner.

Patna High Court CR. MISC. No.73037 of 2022(3) dt.19-06-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Chapra in connection with Mahila P.S. Case No. 53 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
