JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-11-2019 The petitioner seeks bail in anticipation of his arrest in connection with Dhanaha P.S. Case No. 98 of 2019, dated 19.06.2019, instituted for the offences under Sections 341, 323, 324, 354, 307, 379 and 504/34 of the Indian Penal Code.

It appears from the prosecution version that because of an old enmity and a case having been lodged against the petitioner and others, an occurrence took place in which some of the persons have been injured, but with only simple injuries. There is a counter version of the occurrence as well and the persons from the side of the petitioner also

Patna High Court CR. MISC. No.70771 of 2019(2) dt.27-11-2019 2/2 appear to have been injured. It has further been submitted that two of the accused persons, under similar circumstances, have been granted anticipatory bail by a Bench of this Court vide order dated 23.09.2019 passed in Cr. Misc. No. 58896 of 2019.

The petitioner has no criminal antecedent.

Considering this aspect of the matter, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran, in connection with Dhanaha P.S. Case No. 98 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
