JUSTICE ANIL KUMAR SINHA ORAL ORDER 05-11-2019 The petitioners apprehend their arrest in connection with Bihta P. S. Case No. 680 of 2019 registered under Sections 201 and 304B/34 of the Indian Penal Code.

Allegation against the petitioners, as per FIR, is that daughter of the informant was married to one Dipu Kumar in the year 2018 and after sometime, said Dipu Kumar started demanding four-wheeler vehicle from the deceased daughter of the informant. It has further been alleged that prior to the occurrence, petitioners along with husband of the deceased Dipu Kumar had arrived at the house of the informant and threatened the informant that her daughter would be killed if demand of four-wheeler vehicle would not be fulfilled.

No.65321 of 2019(2) dt.05-11-2019 2/2 Learned counsel appearing on behalf of the petitioners submits that petitioners have unnecessarily been dragged in this case inasmuch as they are not the family members of the husband of the deceased. He further submits that petitioners are outsiders and are one of the co-villagers of the husband of the deceased.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioners are not the family members of the husband of the deceased, as such I am inclined to grant anticipatory bail to the petitioners. Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ACJM-1st, Danapur in connection with Bihta P.S.Case No. 680 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
