The petitioner seeks bail in connection with Pachrukhi P.S. Case no. 94 of 2018 registered under Sections 272, 273, 308, 420 of the Indian Penal Code and Sections 30(a), 38/41 of Bihar Prohibition and Excise Act-2016.

1209 lts. of foreign liquor is said to have been recovered from a tractor and motorcycle and driver of the said tractor and motorcycle, namely, Sanjay Rajbhar and Anil Singh respectively, were apprehended while three accused persons managed to escape. The apprehended accused disclosed the name of the petitioner as one of their fleeing accomplices. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.29590 of 2018(4) dt.18-06-2018 2/2 that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the vehicle in question. He was not apprehended on the spot. He has been falsely implicated in the case by the apprehended accused persons due to animosity. He has no criminal antecedent. He has been languishing in custody since 6.04.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd-cum-Special Judge, Excise, Siwan in connection with Pachrukhi P.S.
