JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-04-2024 The present writ petition has been filed seeking the following reliefs:- "1.(i) For issuance of an appropriate writ(s)/ rule(s)/direction(s) in the nature of Mandamus for quashing the order dated 29.06.2018 passed by District Programme Officer, Darbhanga, by which the petitioner's claim for selection to the post of Anganbari Sevika under Anganbari Centre No.210, Ward

Patna High Court CWJC No.18492 of 2022(2) dt.23-04-2024 2/3 No.9 in the Gram Panchayat Raj Makrampur has been rejected and the selection of Smt. Bhawana Devi (Respondent No.6) has been affirmed.

(ii) For issuance of direction to the concerned respondents to appoint the petitioner to the post of Anganbari Sevika under Anganbari Centre No. 210, Ward No.9 in the Gram Panchayat Raj Makrampur, in place of the respondent no.6, on the ground that the respondent no.6 is living outside of Nutritious Area of Ward No.09 and her father-in-law is a PDS licensee and the mother-inlaw of the respondent no.6, namely, Albeli Devi is also working as an Anganbari Sevika at Sahani Tola of Gram Panchayat Raj Makrampur.

(iii) Or Alternatively for issuance of direction to the Collector, Darbhanga for disposing of the Anganbari Appeal No.155 of 2018, by passing a reasoned and speaking order, after considering all the facts and circumstances of the case."

At the outset, the learned counsel for the petitioner has limited the prayer made in the present

Patna High Court CWJC No.18492 of 2022(2) dt.23-04-2024 3/3 writ petition to issuance of a direction upon the Collector, Darbhanga to dispose off the pending Anganbari Appeal No. 155 of 2018, which has been filed by the petitioner, within a stipulated time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Collector, Darbhanga to dispose off the aforesaid appeal, in case the same is still pending, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks of receipt/production of a copy of this order. 5.

The writ petition stands disposed off on the aforesaid terms.
