JUSTICE SATYAVRAT VERMA ORAL ORDER 21-03-2023 Heard learned counsel for the petitioner, learned counsel for the State, Mr. Kinkar Kumar assisted by AC to SC9, Ms. Deepika Sharma and learned counsel for the Zila Parishad.

Learned counsel for the petitioner at the outset submits that the petitioner would be satisfied in the event, if a direction is given to the Chief Executive Officer, Zila Parishad, Supaul to dispose of his representation dated 10.08.2017 contained in Annexure 1 (A) in the writ application by which he

Patna High Court CWJC No.16318 of 2017(2) dt.21-03-2023 2/2 has sought certain relief with regard to the fact that the bus stand which was settled in his favour, he could not collect the toll tax for reasons stated in the application.

The learned counsel for the Zila Parishad objects to the submissions made by the learned counsel for the petitioner and submits that petitioner be directed to file a fresh representation seeking redressal of his grievance. In the event, if the petitioner files an application by 06.04.2023, before the Chief Executive Officer, Zila Parishad, seeking his redressal as pleaded in the present writ application, the Chief Executive Officer, Zila Parishad, shall dispose of the same after considering the representation and giving an opportunity of hearing to the petitioner within a period of two months.

In the event, if no such fresh representation is filed by 06.04.2023, then the present order shall not be given effect. The writ application is disposed of.
