The petitioner seeks regular bail in connection with Pasraha P.S. Case No.109 of 2016 registered for the offences punishable under Sections 147, 149, 427, 307 and 385 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that 10-12 persons intercepted the vehicle of the informant and this petitioner opened fire which damaged the glass of the vehicle of the informant and the gun powder touched the body of the driver.

It has been submitted that the allegation against this petitioner is false and frivolous. The present case has been lodged on account of local politics. The driver was treated by the doctor

Patna High Court Cr.Misc. No.30514 of 2018 (3) dt.04-07-2018 who has reported simple injury caused by hard and blunt substance. The petitioner is in custody since 19.03.2018 and so he deserves bail.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of Miss Simmi Kujur, Judicial Magistrate 1st Class, Khagaria in connection with Pasraha P.S. Case No.109 of 2016.
