2. The petitioner apprehends his arrest in Danapur P.S. Case No. 208 of 2022, registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the Court of learned Additional Sessions Judge-V, Danapur (Patna).

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.78951 of 2023(2) dt.08-12-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that the petitioner has no criminal antecedent and only on the basis of confessional statement made before the police he has been made accused in the present case, which is not an evidence in law.
