JUSTICE ARUN KUMAR ORAL ORDER 19-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.4.2018, seeks bail in Rajpur PS Case No. 333 of 2017, Pocso Case No. 47 of 2017 registered under Sections 376, 313/34 of the IPC and Section 12 of the Pocso Act.

The allegation in brief is that the petitioner established sexual relationship with one girl and thereafter she was called at Buxar and she was taken to some other place in the train, the petitioner mixed some intoxicating material in the mixture, after eating the same the girl became unconscious and she was found at Jamui by the GRP which handed her over to Child Welfare Committee, Jamui and thereafter to Buxar Child Welfare Committee on 12.12.2017 but before that she was aborted. Learned Counsel for the petitioner submits that there is no evidence that the girl was pregnant and it is strange how her pregnancy was terminated while she was in the custody of Child Welfare Committee Jamui.

Having considered the said facts and circumstances, the petitioner, namely, Sonu Shah @ Sonu Sah is directed to be released

Patna High Court Cr.Misc. No.30563 of 2018 (4) dt.19-07-2018 on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, I, Buxar in connection with Rajpur PS Case No. 333 of 2017, Pocso Case No. 47 of 2017.
