The petitioner seeks bail in Amba P.S. Case No. 22 of 2018 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.
Informant who is a police officer has stated in his fardbeyan that on 29.03.2018 at about 4:30 pm he received secret information that two persons are going to Amba Market with stolen motorcycle and on receipt of such information he along with other police officials reached Amba Market and saw two persons riding on Red Colour Hero Honda Motorcycle. On seeing the police party one miscreant fled away and petitioner was apprehended by the police along with the motorcycle. Police demanded ownership documents but the petitioner was
Patna High Court Cr.Misc. No.31891 of 2018(5) dt.13-08-2018 2/2 unable to produce any valid document of ownership. It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since 30.03.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Amba P.S. Case No. 22 of 2018.
