The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392, 411 of the Indian Penal Code.

As per allegation in the FIR, three miscreants on gunpoint snatched the key of the motorcycle of the informant's brother and also snatched informant's gold chain and fled away. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Stolen gold chain was recovered from possession of co-accused Biru Yadav and not from the possession of the petitioner, which was being identified by the informant. Patna High Court CR. MISC. No.75942 of 2023(2) dt.30-11-2023 2/2 already been enlarged on bail by another coordinate Bench of this Court vide order dated 20.09.2023 passed in Cr. Misc. No. 61563 of 2023. Petitioner is languishing in judicial custody since 15.6.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad, Bihar in connection with Barun P.S. Case No. 192 of 2023.
