The petitioner apprehends his arrest in connection with Teghra P.S. Case No. 293 of 2019 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

The allegation is regarding recovery of 360 liters of illicit liquor from the open verandah of the house of the petitioner.

The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case and as far as recovery of meager quantity of illicit liquor is concerned, the same has been recovered from open place situated in the house of the petitioner and it cannot be said

Patna High Court CR. MISC. No.75512 of 2019(3) dt.12-12-2019 2/2 that the same belongs to the petitioner, hence the provisions of the Bihar Prohibition and Excise Act, 2016 are not attracted in the present case. It is further submitted that the petitioner is having a clean antecedent.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner above named is directed to be released on anticipatory bail on furnishing bailbonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cumSpecial Judge, Excise Act, Begusarai in connection with Teghra P.S.
