Learned counsel for the petitioner seeks permission to make correction in paragraph-3 of the bail petition and he is permitted to do so.

The petitioner seeks bail in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

217.85 liters of wine is said to have been recovered from the bamboo clump of Rana Yadav and petitioner and other accused persons watching the said wine managed to escape seeing the police party.

No.29251 of 2018 (03) dt.19-06-2018 2/ 2 It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case at the instance of his enemy. He has no concern either with the seized liquor or the place of recovery. Though three more criminal cases have been lodged against the petitioner but he has been acquitted in the aforesaid cases. He has been languishing in custody since 11.04.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-III-cumSpecial Judge Excise Act, Khagaria in connection with Parawata P.S. Case No.117 of 2018.
