====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 13-08-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Ahiyapur P.S. Case No. 409 of 2017 registered for the offences punishable under Sections 304(B)/34 of Indian Penal Code.

Informant is the father of deceased, who in his FIR has stated that his deceased daughter was married to petitioner about one year and one month earlier and he had given gifts and cash money at the time of marriage, but the daughter was being tortured for non-fulfillment of demand of dowry and he received information from the villagers that her daughter has been murdered by the accused persons. After investigation the police has found to be a case of abatement of suicide and has submitted

Patna High Court Cr.Misc. No.32600 of 2018(5) dt.13-08-2018 2/2 charge-sheet under Section 306 of Indian Penal Code against petitioner. According to postmortem report death is due to asphyxia.

It has been submitted that petitioner has no criminal antecedent and he is in custody since 19.12.2017. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur, in connection with Ahiyapur P.S. Case No. 409 of 2017.
