The petitioner seeks bail in a case registered under Sections 353, 414/34, 120(B) of the Indian Penal Code and Sections-25(1-B)a/26/27/35 of the Arms Act.

The prosecution case in short is that on secret information, the police intercepted the petitioner and other accused. In this occurrence, firing was made by the accused persons. One of the accused was arrested in this case.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 16-03-2019. Charge sheet has already been submitted. None is said to have been

Patna High Court CR. MISC. No.67372 of 2019(2) dt.22-10-2019 2/2 injured in course of the occurrence. Arms is said to have been recovered from the co-accused, Deepu. The petitioner was not arrested at the spot. The petitioner has been falsely implicated in the present case. The name of the petitioner transpired in this case on the basis of disclosure made by the co-accused, Deepu Kumar.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Danapur, Patna in connection with Dulhin Bazar P.S. Case No. 295 of 2018.
