Petitioner, who is in custody, seeks bail in connection with Mithanpura P.S. Case No. 34 of 2018 registered for the offences punishable under Sections 498(A), 323, 365, 504, 506 and 34 of the Indian Penal Code. It has been submitted on behalf of petitioner that his wife was suffering from mental disorder from prior to marriage and she was being treated in Mental Hospital and use to visit her parental home and matrimonial home frequently. Two children are born from said wedlock. She became traceless from 02.02.2018 and efforts were made to trace her but on basis of false allegation F.I.R. has been instituted of dowry demand although 8 years before marriage was solemnized.

Patna High Court Cr.Misc. No.38230 of 2018(4) dt.13-09-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. He has no criminal antecedent. He is in custody since 22.02.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, East Muzaffarpur in connection with Mithanpura P.S.
