The petitioner seeks bail in connection with Jagdishpur P.S. Case No.304 of 2018 registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the case was registered against unknown accused persons. The name of the petitioner transpired in course of confessional statement of one Rupak Kumar Yadav, which has been recorded in paragraph 83 of the case-diary. Said Rupak Kumar Yadav @ Rupak Kumar has already been granted bail by a Bench of this Court vide order dated 02.11.2018 passed in Cr.Misc. No.69965 of 2018. Other co-accused persons, namely, Tinku Yadav, Ajay

Patna High Court CR. MISC. No.69562 of 2019(2) dt.04-12-2019 2/2 Singh & Anr., Sonu Kumar @ Sonu Kumar Yadav, Bamshankar Kumar @ Panna Singh and Balbir Yadav @ Bablu have already been granted bail by different orders passed by different Benches of this Court. He has further contended that the case of the petitioner stands on better footing than those who are already granted bail.

Submissions made by the learned counsel for the petitioner have not been controverted by the learned counsel for the State.

Considering the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No.304 of 2018.
