2. The petitioner is in judicial custody in connection with the Imadpur P.S. Case No. 86 of 2024 for the offence punishable under Sections 309(4)/3(5) of the B.N.S. lodged on 05.08.2024 by the informant, Shyamuddin Ansari.
3. As per the prosecution story, the informant alleged that he runs CSP of the Bank of India and on the fateful day, the accused came to the counter and after threatening with the gun, took away Rs. 2,40,000/- on motorcycle. This led to the case.
4. Learned counsel for the petitioner submits that his name has come in the confessional statement of Priyanshu Kumar and nothing has been recovered from his conscious possession whereas learned APP opposes the prayer submitting
Patna High Court CR. MISC. No.76610 of 2024(2) dt.28-10-2024 2/2 that during investigation, Priyanshu Kumar was taken into custody and he spilled the beans which brought the role of the petitioner into picture. The fact that the looted money and the gold ornaments has been recovered from the said co-accused who gave the name of the petitioner cannot be ignored.
5. Taking into account the aforesaid facts, for the present, this Court is not inclined to extend him the privilege of bail which is accordingly rejected.
