Petitioner seeks bail in a case registered for the offences punishable under Sections 376, 511, 323, 379, 506/34 of the Indian Penal Code.
According to F.I.R., the petitioner attempted to ravish the informant on 26.02.2018. It is further stated that petitioner had committed murder of the father of the informant in the year, 2014.
Submission of the learned counsel for the petitioner is that false and concocted allegation is there for the reason that Title Suit No.140 of 2008 is going on between the parties in the court of learned Civil Judge, Senior Division, Madhepura, wherein informant is also a party after death of her father. Just
Patna High Court Cr.Misc. No.36160 of 2018(3) dt.28-08-2018 2/2 to pressurize false allegation has been leveled. Finding substance in the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Chousa Police Station Case No.43 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
