2. The petitioner seeks bail in Nautan P.S. case No. 276 of 2024 instituted for the offences under Sections 127(1), 115(2), 118(1), 109, 74, 329(4), 351(2), 3 (5) of Bhartiya Nyaya Sanhita, 2023.
3. Prosecution allegation, in short, is that the accused persons entered into the house of the informant and assaulted the informant and her family members due to which they sustained injury. It is further alleged that petitioner assaulted on the head of the husband of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The allegation is that petitioner assaulted Kapildeo Yadav with farsa who is husband of the informant and the injury is found to be grievous in nature caused by hard and blunt substance. Hence the allegation made in the F.I.R. does not corroborate with the injury report. The present case is counter blast of Nautan P.S. case No. 267 of 2024 lodged by the petitioner against the present prosecution party. There is persisting land dispute between the parties. Charge-sheet has been submitted in this case. The petitioner is in custody since 31.07.2024 and has one criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, charge-sheet being submitted and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with
Patna High Court CR. MISC. No.77289 of 2024(2) dt.26-10-2024 3/3 two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nautan P.S. case No. 276 of 2024.
