In this case, the petitioner is seeking regular bail in connection with Chapra Muffasil P.S. Case No. 588 of 2021, registered for the offences punishable under Sections 341, 323, 324, 307, 504/34 of the IPC and later on Section 302 of the IPC has been added.

As per allegation, when the brother of the informant was going to Hanuman Mandir, three named accused persons Rajesh Singh, Vicky Kumar and the petitioner started assaulting him with lathi, iron rod, etc. He became injured and with the help of villagers, he was shifted to the hospital. Initially, the FIR was registered under Sections 341, 323, 324, 307 and 507/34 of the IPC but after death of the injured, Section 302 of the IPC

Patna High Court CR. MISC. No.72446 of 2022(3) dt.28-06-2023 2/2 was added on 18.12.2021.

The learned counsel for the petitioner has submitted that he is innocent. He was not arrested at the spot and on exactly similar footing, co-accused Rajesh Singh has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 69439 of 2022 vide order dated 21.06.2023. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M. Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 588 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to cancelled.
