JUSTICE ARUN KUMAR ORAL ORDER 06-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.12.2017, seeks bail in H.Kharagpur (Shampur) PS Case No. 174 of 2017 registered under Section 302/34 of the IPC.
The allegation in brief is that the petitioner's wife was killed by setting her body on fire for non fulfillment of demand of dowry. Learned Counsel for the petitioner submits that the petitioner's wife died due to accidental burn injury as she caught fire while preparing meal.
Whereas learned Counsel for the State submits that the petitioner is husband having specific accusation of torturing his wife in order to realise further demand of dowry and there is no evidence in the case diary to suggest that it is a case of accidental burn injury. Having considered the said facts and circumstances, the prayer for bail of the petitioner is presently rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of one and half years. Snkumar/- (Arun Kumar, J) U T
