JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2018 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for State. Earlier, the prayer for bail of the petitioner was rejected by this court vide order dated 24.10.2016 passed in Cr. Misc. No. 33832 of 2016.
The learned trial court vide letter no. 164 of 2018 dated 14.08.2018 has reported that the case of the petitioner was pending for argument but the petition under section 313 of the Cr. P. C was filed on behalf of the accused persons of the case and the case is pending for hearing on the above stated petition. In view of the aforesaid facts and circumstances, again, I am not inclined to release the petitioner on bail and
Patna High Court Cr.Misc. No.40152 of 2018 (5) dt.05-09-2018 2/2 accordingly, his prayer for bail in connection with S. T. No. 609 of 2016 arising out of Harnaut P. S. Case No. 157 of 2015 stands rejected.
However, learned trial court is directed to dispose of the petition filed under section 313 of the Cr. P. C on behalf of the accused persons as well as trial of the petitioner within two months from the date of receipt/production of a copy of this order, failing which the matter shall be viewed seriously.
