2. Petitioner seeks regular bail in connection with Govindganj P. S. Case No. 393/2021 in a case registered for the offence punishable under Section 279, 337, 338 and 304(a) of the Indian Penal Code. Later on Sections 302 and 34 of the IPC was also added.

3. As per the prosecution case, informant alleged that on 16.12.2021 at about 9 PM when brother of the informant along with one Sujeet Kumar Singh was going for work to Motihari, then they met with accident and due to which brother of the informant died and Sujeet Kumar Singh sustained injury.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.71650 of 2025(2) dt.04-11-2025 2/2 the petitioner is not named in the FIR, the name of the petitioner transpired during the course of investigation only on suspicion. It is a case of accidental death due to rash and negligent driving. Petitioner also sustained injury in the same accident due to fall from the motorcycle. Petitioner claims clean antecedent and he is in custody since 29.07.2025.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, 1st Class, Motihari, East Champaran in connection with Govindganj P. S. Case No. 393 of 2021.
