Petitioner is apprehending his arrest in connection with Complaint Case No.466©/18 , registered for offences punishable under Sections 323, 406, 384 of the Indian Penal Code.
As per the complaint case, complainant has taken loan from the petitioner on mortgage for three years and she has cultivated the same for one year and later one petitioner did not allow her to cultivate the land and also assaulted her. Submission of the learned counsel for the petitioner is that no such paper of mortgage has been produced by the
Patna High Court CR. MISC. No.68559 of 2019(2) dt.25-10-2019 2/2 complainant and the whole allegation is false and concocted and earlier to that two cases had been lodged by the petitioner's side against the complainant and others. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Masaurhi, Patna in connection with Complaint Cases no.466© of 2018, subject to conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
