The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. Petitioner no.1 Ram Yugal Ram @ Ram Jugal allegedly caused injury at the head of the informant. Submission is that there is case and counter case and there is no allegation of repetition of blow. The doctor has found simple injury on the person of the injured.

Considering the fact that petitioner no.1 Ram Yugal

Patna High Court CR. MISC. No.79053 of 2019(2) dt.18-12-2019 2/2 Ram @ Ram Jugal had knowledge that his act might cause death, I am not inclined to grant anticipatory bail to petitioner no.1 Ram Yugal Ram @ Ram Jugal. His prayer for anticipatory bail is rejected.

Other petitioners carry general and omnibus allegation of assault and there is case and counter case, hence, let the petitioners, namely, Surendra Ram and Naresh Ram be released on anticipatory bail in the event of their arrest or surrender in the court below within a period of thirty days from the date of receipt of the order, on furnishing bail bond of Rs.20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Dumra P.S.Case No.96 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
