Petitioners seeks bail in NDPS P.S. Case No. 17 of 2018 arising out of Dumariyaghat P.S. Case No. 49 of 2018 registered for the offence punishable under Sections 27(b)(ii) of the Drugs and Cosmetics Act, and 22(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Allegation against the petitioners is of recovery of 630 bottles of Phensedyl Syrup from the vehicle in which they were travelling.
It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case.
Patna High Court Cr.Misc. No.40190 of 2018(4) dt.18-09-2018 2/2 Petitioners have got no criminal antecedent and are in custody since 23.03.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran at Motihari, in connection with NDPS P.S. Case No. 17 of 2018 arising out of Dumariyaghat P.S. Case No. 49 of 2018.
