Petitioner seeks bail in Chakia P.S. Case No. 249 of 2017 registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code.

Allegation against the petitioner is of committing theft of Water Motor Pumps of various brands, and printer of HP as well as cash of Rs. 95000/- from the shop of the Informant. It has been submitted on behalf of the petitioner that the petitioner has been implicated in this case on suspicion only. It has been further submitted that the articles were recovered from the possession of different person, who has been made accused in this case. Nothing has been recovered from the possession of the petitioner. Petitioner has got no criminal

Patna High Court Cr.Misc. No.40298 of 2018(3) dt.18-09-2018 2/2 antecedent and is in custody since 13.12.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM-13, East Champaran, Motihari, in connection with Chakia P.S. Case No. 249 of 2017.
