Petitioner seeks bail in Visvidyalaya(LNMU) P.S. Case No. 48 of 2004 (S. Tr. No. 215 of 2017) registered for the offence punishable under Sections 379, 411/34 of the Indian Penal Code.
Informant is the SHO of LNMU P.S. who in his written report has stated that he received secret information that some miscreants who are involved in committing theft in buses and trains have assembled at Kadirabad Bus Stand. Thereafter

No.42771 of 2018(3) dt.25-08-2018 2/3 he alongwith other police personnel conducted raid at the aforesaid bus stand and found four miscreants boarded on the Jeep bearing registration no. BR 7P 5321 which was going towards Simri and chased the jeep and arrested four accused persons who disclosed that other accused persons are hiding in Tara Hotel at Darbhanga. Thereafter he again conducted raid in the aforesaid hotel and arrested petitioner alongwith other accused persons.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Similarly, situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 15.09.2004 in Criminal Miscellaneous No. 27127 of 2004, 11.10.2004 in Criminal Miscellaneous No. 30926 of 2004, 11.10.2004 in Criminal Miscellaneous No. 30926 of 2004 and 08.12.2004 in Criminal Miscellaneous No. 37274 of 2004. Petitioner has got no criminal antecedent and is in custody since 03.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Darbhanga, in connection with
