JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 A supplementary affidavit has been filed on behalf of the petitioner annexing the statement of the victim girl recorded under Section 164 of the Cr.P.C., which is taken on record. Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kadwa P.S. Case No. 173 of 2019 for the offence under Sections 366A/120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 20.06.2019. He further submits that the victim girl on her recovery, in her statement recorded under Section 164 Cr.P.C. has stated that she has voluntarily left her residence along with Md. Zahid and not with the present petitioner. Considering the statement of the victim girl recorded
