The petitioner seeks bail in Sessions Trial No.207 of 2016 arising out of Darihat P.S. case No.01 of 2015 registered under Sections 302/34 of the I.P.C., pending in the court of Additional District and Sessions Judge VII, Rohtas at Sasaram. The earlier bail application of the petitioner was rejected vide Anneuxre 1 to the present application taking into account that the petitioner is the husband of the deceased. The onus is on him to explain the cause of death of the deceased. A report was called for from the court below regarding the stage of the trial. It has been reported that two prosecution witnesses have already been examined and the trial

Patna High Court Cr.Misc. No.39180 of 2018(3) dt.02-08-2018 2/2 is expected to be concluded within a period of six months. Considering the accusation and the stage of the trial, I am not inclined to granted bail to the petitioner. The same is rejected.
