2. Lastly, the prayer for bail of petitioner was rejected, vide order dated 17.05.2023 passed in Cr.Misc. No. 9131 of 2023 with an observation to conclude the trial within a period of one year from the date of receipt/production of copy of this order. At that point of time, all the five charge-sheeted witnesses were already examined and the case was running at the stage of argument.

3. Trial Court report reveals that the case is still running at the stage of argument.

4. It is submitted on behalf of petitioner that even after lapse of more than one year, trial has not concluded and case is still fixed at the stage of argument. Petitioner is in custody since 09.05.2021, having no criminal antecedent.

5. Considering the period of custody and tardy progress of trial, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 2nd, Lakhisarai in connection with Piribazar P.S. Case No. 64 of 2021. (Prabhat Kumar Singh, J) anay U T
