2. The petitioner apprehends his arrest in connection with Mehus P.S. Case No. 30 of 2023 registered for the offences punishable under Sections-25(1-b)a, 26 of the Arms Act.
3. Allegedly, while the informant along with police personnel left the police station to apprehend the accused of pending cases, he saw a Motorcycle parked on the road and one rifle is said to have been recovered from the sack tied with the motorcycle whereas one country-made katta/pistol is said to have been recovered from the dicky of the motorcycle.
4. Learned counsel for the petitioner has submitted that allegedly, one pistol was recovered from a motorcycle bearing
Patna High Court CR. MISC. No.73512 of 2023(2) dt.09-11-2023 2/2 Registration No. BR52D-6258 which was parked on the western side of the road. When the police interrogated from owner of the vehicle, he named this petitioner and only on that basis, he has been implicated in the present case. Neither he is owner of the motorcycle, in question nor any incriminating article was recovered from his possession.
5. Learned Additional Public Prosecutor opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, learned Judicial Magistrate-Ist Class, Sheikhpura in connection with Mehus P.S. Case No. 30 of 2023, subject to condition as laid down under section 438(2) Cr. P.C.
