JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1455 of 2016 disclosing offences under Sections 323, 504, 420 and 427 of IPC. As per prosecution case, petitioner no.2 has executed a sale deed with respect to a piece of land in favour of the complainant, but later on, she came to know that land does not belong to him. The petitioner no.1 is the husband of petitioner no.2 and petitioner no.3 is witness on that sale deed. Submission of the learned counsel for the petitioners
Patna High Court CR. MISC. No.72276 of 2019(2) dt.17-01-2020 2/2 is that with respect to the same, a title suit has already been filed by the complainant for cancellation of the sale deed. Further he has failed to satisfy that the land belongs to the petitioner no.2. Heard learned A.P.P. also.
Having heard both sides, considering the above submissions, so far petitioners no.1 and 2 are concerned, I am not inclined to grant privilege of anticipatory bail to them. So far petitioner no.3 is concerned, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Samastipur, in connection with Nautan P. S. Case No. 118 of 2019.
