JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-03-2020 Heard Mr. Syed Maslehuddin Ashraf for the petitioner and Mr. Aslam Ansari for the State. The petitioner, who is in custody since 17.04.2019, seeks bail in connection with Ishakchak Police Station Case No. 54 of 2019, dated 04.04.2019, instituted for the offence under Sections 395 and 120 B of the Indian Penal Code.

The petitioner is not named in the F.I.R. and there is no recovery of any looted article from him or from his constructive possession. Despite being in custody since 17.04.2019, he has not been put on Test Identification Parade. However the petitioner is said to have been made accused in six other cases, but in all such cases, he is on bail.

No.78432 of 2019(4) dt.16-03-2020 2/2 Regard being had to the aforestated facts the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak Police Station Case No. 54 of 2019.

The application stands allowed.
