JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sheosagar P.S. Case No. 294 of 2016 registered under sections 341, 323, 379, 354,(A), 448, 504 and 506/34 of the Indian Penal Code.

Allegation of informant Hafiz Mohammad Tayyab is that on 22. 11.2016 he had gone to in his field whereas his two sisters namely, Shabrin Praveen, aged 18 years and Taibun Nisha, aged 16 years were present in the house and at that time petitioners along with Ibrar Ansari, seeing them alone, entered in the house and try to establish physical relationship but both of them made protest in which both sustained injury also and at that time golden chain of Shabrin Praveen was also snatched.

Patna High Court Cr.Misc. No.15254 of 2017 (3) dt.09-05-2017 2/2 Learned counsel appearing on behalf of the petitioners submits that petitioners have falsely been implicated in this case due to dispute of next door neighbour. Having considered the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, prayer for anticipatory bail of the petitioners is rejected.

The petitioner may surrender before the court below within a period of four weeks and seek regular bail which will be considered by the court below on its own merit without being prejudiced by the order of this court on the same day. (Rajendra Kumar Mishra, J) Ravi/- U T
