2. The petitioner seeks regular bail in a case registered for the offence under Sections 363, 366A 376(1), 376(2)(N), 376(3) and 506 of the Indian Penal Code and Section 4, 8 and 12 of the POCSO Act.

3. As per the prosecution case, a 14 year girl was mislead by the petitioner who is 30 years old and she was taken to Mumbai and sexually assaulted by the petitioner.

4. The Victim girl in her detailed statement recorded under Section 164 of the Cr.P.C. has mentioned the misdeeds of the petitioner who used to sexually assault the

Patna High Court CR. MISC. No.77147 of 2023(3) dt.24-01-2024 2/2 victim, physically assault the victim and after she came back to Bihar, he used to threaten her and send her photographs which he had taken of her.

5. Considering the allegation levelled against the petitioner and the fact that victim is a 14 year old minor girl, I am not inclined to grant bail to the petitioner. This application for regular bail is dismissed.

6. The Court below is directed to expedite the trial of the petitioner/s.
