Petitioner seeks bail in Nardiganj P.S. Case No. 125 of 2016 registered for the offence punishable under Section 414 of the Indian Penal Code.

Informant is the police officer who in his written report has stated that on 27.08.2016 at about 2:00 pm, he was on patrolling duty and checking the vehicles and one person riding the motorcyle after seeing the police left the motorcycle and tried to flee away but he was chased and apprehended by the police and he disclosed his name as Chunu Kumar but could not produce the ownership papers of the motorcycle and as such was arrested before the two independent witnesses. It has been submitted on behalf of the petitioner that

No.43661 of 2018(3) dt.29-08-2018 2/2 the name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused Chunnu Kumar and except that confessional statement there is no incriminating material against the petitioner. Petitioner is in custody since 14.05.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Nawada, in connection with Nardiganj P.S.
