JUSTICE HARISH KUMAR ORAL ORDER 20-05-2025 Heard learned Advocate appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State as well as the learned Advocate for the opposite party no. 2.
2. The petitioner has been apprehending his arrest in connection with Sheohar Mahila P.S. Case No. 23 of 2024, registered for the offences punishable under Sections 341, 323, 342, 498A and 504 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.
3. The marriage of the petitioner with the opposite party no. 2 was solemnized long back in the year 2013, however, it is alleged that soon after the marriage she was
Patna High Court CR. MISC. No.78019 of 2024(4) dt.20-05-2025 2/3 subjected to the demand of dowry and on account of non-fulfillment of the same, she was tortured and ousted from the matrimonial home.
4. There is complete denial of the allegation and submission has been made that after such a long delay, any demand of dowry does not inspire any confidence. In fact, the opposite party no. 2 does not want to live with the petitioner, on account of he being physically disabled.
5. Learned Advocate appearing on behalf of the opposite party no. 2 has refuted the contention. The matter was earlier sent to the Patna High Court Mediation and Conciliation Centre, however, despite the best effort, the dispute between the parties could not be resolved.
6. At this stage, learned Advocate for the petitioner shown his good gesture and submits that he is ready to pay an amount of Rs. 2,500/- per month.
7. Considering the submissions advanced, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sheohar in
Patna High Court CR. MISC. No.78019 of 2024(4) dt.20-05-2025 3/3 connection with Sheohar Mahila P.S. Case No. 23 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner and also with a condition that the petitioner shall ensure payment of Rs. 2,500/- in the account of the opposite party no. 2 duly furnished to the petitioner within first week of every month, till any order is passed by competent Civil Court.
