JUSTICE SANJAY PRIYA ORAL ORDER 4/ 03-10-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Union of India. Petitioner seeks bail in Special Case No.94 of 2017 arising out of Patna Thana P.S. Case No. D.R.I. 17 of 2017 instituted for the offence under Section(s) 20(b), 23, 25 and 29 of N.D.P.S. Act pending in the Court of Additional Sessions Judge-cum-Special Judge, C.B.I.No.2, Patna.
It has been alleged that one truck was intercepted by the police on 11.07.2017 at Bakhtiyarpur-Patna N.H. and from the specially built cavity behind the wall of driver's cabin huge quantity of Ganja total 800 Kg. has been recovered. The petitioner was driver of the aforesaid vehicle. He could not
Patna High Court Cr.Misc. No.50034 of 2018 (4) dt.03-10-2018 2/2 produce any valid paper in support of aforesaid article. He was arrested by the police. His statement was recorded, wherein, he has admitted that aforesaid Ganja was kept in the truck within his knowledge.
In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
