The petitioner, who is in custody, seeks bail in connection with Mahila Sadar (Laheriasarai) P.S. Case No. 21 of 2018 registered for the offence punishable under Sections 376,506 and 323 of the Indian Penal Code and Section 4/6 of the POCSO Act.
Allegation against petitioner is establishing physical relation with informant for last few months on promise of marriage. Informant has been medically examined and has been assessed to be 16 to 17 years. No sign of recent sexual intercourse has been found in Medical examination. It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.41649 of 2018(3) dt.13-09-2018 2/2 the petitioner is innocent and has falsely been implicated in this case. He has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge (POCSO Act), Darbhanga, in connection with Mahila Sadar (Laheriasarai) P.S. Case No. 21 of 2018.
