JUSTICE SANJAY PRIYA ORAL ORDER 24-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Town P.S. Case No. 842 of 2016 instituted for the offence under Section 420 of the Indian Penal Code.

In the written report it is alleged that unknown person has changed the A.T.M. card of informant. Thereafter, the informant received message with regard to withdrawal of money from account due to purchase of articles from "Big Mart". Counsel for the petitioner submits that petitioner is not named in the written report. He is in custody since 16.02.2018. The name of petitioner has come during investigation on the basis of CCTV camera footage.

Patna High Court Cr.Misc. No.41879 of 2018 (3) dt.24-09-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub Judge-15th, Muzaffarpur, in connection with Town P.S. Case No. 842 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
