The petitioner is languishing in custody in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

As per the prosecution case, five miscreants looted a cash box containing Rs. 1,00,456/-, a mobile phone and the other important documents from the informant's petrol pump on the point of pistol.

It is submitted by learned counsel for the petitioner that petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to enmity and dirty village politics. The petitioner is not named in the F.I.R and his name subsequently sprang up on the basis of confessional

Patna High Court CR. MISC. No.77889 of 2023(2) dt.05-12-2023 2/2 statement of co-accused Munna Kumar. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated other accused person has already been enlarged on bail by this Court vide order dated 24.06.2023 passed in Cr. Misc. No. 33016 of 2023. The petitioner has got no criminal antecedent and languishing in custody since 16.08.2023.

Learned APP appearing for the State has opposed the prayer of Bail.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar in connection with Daudnagar P.S. Case No. 680 of 2022.
