The petitioner has filed the instant application for anticipatory bail apprehending his arrest in connection with Kotwali P.S. Case No. 607 of 2016 (District Patna) registered for the offence under section 290 of the Indian Penal Code and section 37(b)(c) of the Bihar Prohibition and Excise Act, 2016. As per the allegation in the FIR, on information, when the informant reached the place of occurrence a person in a drunken state was creating nuisance. It is further stated that on enquiry he disclosed that he was in the party given by his friend i.e. the petitioner, where he was given foreign liquor. It is submitted by learned counsel for the petitioner that the allegation as leveled in the FIR are false and incorrect. Besides the so called statement of one Abdulla @Tipu made before the police there is no other material against this petitioner
Patna High Court CR. MISC. No.70569 of 2019(3) dt.20-11-2019 2/2 and the alleged offence as leveled in the FIR are also not made out against him.
The application for bail has been opposed by learned APP for the State.
Having heard the learned counsel for the parties and taking into consideration the facts and circumstance of the case, the court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Kotwali P.S. Case No. 607 of 2016 (G.R. No. 7929/2016) is directed to be enlarged on bail on furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code.
