The petitioner seeks bail in connection with Sessions Trial No. 167 of 2018 arising out of Akbar Nagar P.S. Case No. 90 of 2017 registered for the offence punishable under Sections 25(1-a),25(1-AA), 25(1-B)a, 26 and 35 of the Arms Act.

Informant is the Officer-in-Charge of Akbar Nagar P.S. who in his written report has stated that he received confidential information that arms are being manufactured at Bhitha Diyara and upon receiving such information he proceeded towards the place of occurrence and saw 10 miscreants engaged in manufacturing of arms and apprehended six persons from the spot.

Patna High Court Cr.Misc. No.42965 of 2018(3) dt.21-08-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case as he is a labourer. It has been further submitted that similarly, situated co-accused persons have been granted bail by coordinate benches of this Court vide orders dated 06.07.2018 passed in Criminal Miscellaneous No. 26446 of 2018 and 19.07.2018 in Criminal Miscellaneous No. 42241 of 2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, 1st Bhagalpur, in connection with Sessions Trial No. 167 of 2018 arising out of Akbar Nagar P.S. Case No. 90 of 2017.
