The petitioners apprehend their arrest in Barhara (Sinha O.P.) P.S. Case No.259 of 2019, registered under Sections 341, 323, 324, 435, 307, 504, 506 and 34 of the Indian Penal Code. The informant alleged that while he was grazing his buffalo, the petitioner having armed with sticks, iron rod came and indiscriminately assaulted the informant.

Learned counsel for the petitioners submits that earlier to

Patna High Court CR. MISC. No.66036 of 2019(2) dt.21-10-2019 2/2 the present occurrence, there was quarreling between the children of two families. The petitioner no.4, Gopi Singh @ Gopi Kumar was assaulted by the informant Nand Gopal Yadav and others. The present case is counter version of the case of the petitioner. It is further submitted that Nand Gopal Yadav is alleged to have been indiscriminately assaulted by the six accused persons, the petitioners, but Nand Gopal Yadav got only three lacerated wound on different parts of his body. The opinion of the injuries was reserved for X-ray but Nand Gopal Yadav did not produce any X-ray report and the injuries are simple in nature.

Taking into consideration the facts and nature of allegations made against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara in connection with Barhara (Sinha O.P.) P.S. Case No.259 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
